It's legal now. They must be in control of their vehicle and that includes safe following distance.
I was rear ended last year by another driver and he took it on the chin.

According to a judge I know, it's not following too closely if the person in front stops too suddenly for no reason.
Under my benevolent dictatorship, you'd be free to slam on the brakes out of pure spite and the other person would be at fault.
